… The Court issued a preliminary injunction enjoining Defendant Shkreli (1) from possessing, using, distributing, or selling any rights to the album, including the album data or files, and from so doing causing further damage to Plaintiff with respect to the album; (2) ordering him to produce an inventory and accounting of any copies of the album he holds, any persons to whom he has distributed the data or files, and any associated proceeds; and (3) ordering him to turn over to his counsel all recordings of the contents of the album in his possession or control. A written order will be entered at a later date. In addition, the Court set the following deadlines: (1) by August 30, 2024, Defendant must submit, under penalty of perjury, (A) an affidavit from Defendant certifying that he has delivered to counsel all copies of the album or its contents and that he is not currently in possession of any copies of the album or its contents, and (B) a letter confirming that counsel is in possession of those copies and contents. (2) By September 30, 2024, Defendant shall submit, under penalty of perjury, (A) all known copies of the Album or its contents; (B) whether any such copies have been distributed, and, if so, when, to whom, and how such copies have been distributed; and (C) the amount, source, dates, and nature of any revenue, income, profits, or other pecuniary benefit derived by Defendant from the distribution or reproduction of the Album or its contents.
