Judge Tanya Chutkan held a conference on Thursday to consider the Supreme Court’s presidential immunity ruling in the January 6 lawsuit filed by Jack Smith against President Trump.
Justice Chutkan vehemently dissented from the Supreme Court’s ruling on presidential immunity, saying the upcoming election was “irrelevant.”
Chutkan has not yet ruled, but is expected to issue a scheduling order as early as Thursday evening.
President Trump and special counsel Jack Smith have offered opposing positions on how the January 6 trial should proceed. Joint Status Report The proposal was submitted last Friday night ahead of a status update meeting on Thursday.
Last Tuesday Jack Smith Indicted President Trump returned to Washington DC following the Supreme Court’s ruling on presidential immunity.
A grand jury indicted Trump on the same charges. Four rates The next four charges, announced last August, are conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstructing and attempting to obstruct an official proceeding, and conspiracy against rights.
Trump’s lawyers argued that the ruling provides immunity from federal prosecution for “crimes” that he allegedly committed while serving as president of the United States.
Julie Kelly, who attended the status conference, said Judge Chutkan appeared ill-prepared, cocky and condescending during Thursday’s hearing.

Chutkan repeatedly discussed elements of the Supreme Court’s decision with Trump’s lawyers.
Not only is she clearly upset by the Supreme Court’s immunity decision, but it is unclear whether she has even read the decision.
She repeatedly argued with Trump lawyer John Lauro about elements of the ruling. “That’s not how I read it,” she said, misinterpreting the ruling.

Judge Chutkan said the upcoming election was “irrelevant.”
“I’ve heard there’s an election coming up soon,” Chutkan said.
“That’s irrelevant. This court is not interested in election dates. I’m not going to take that into consideration,” she said.
Chutkan was emotional, emphasizing that the presidential election will not affect her schedule, as she has consistently maintained since the case was placed on her docket. She plans to file a schedule later today.

“I’m not talking about the president of the United States, I’m talking about the four-count indictment,” Chutkan also said during Thursday’s hearing.

She made the sarcastic comments to elicit laughs from the Justice Department-friendly crowd. During her exchange with Lauro, she crossed her arms, raised her hands, pointed and smirked.
